Gutter work in a Mackay rental: who pays and how fast it has to happen.

The lessor pays. Under the Residential Tenancies and Rooming Accommodation Act the lessor must keep the premises in good repair, and since 1 September 2024 the minimum housing standards have required every Queensland rental to be weatherproof and free of damp and mould. A gutter putting water into a ceiling is a serious roof leak, which is an emergency repair: act immediately, and a tenant who cannot reach you can arrange it themselves up to 4 weeks rent. General information for Queensland general tenancies. The Residential Tenancies Authority is the authority on the process, and a specific dispute is decided on its own facts.

Urgent versus non-urgent, and why the difference costs money.

Queensland splits repairs into emergency and routine. The emergency list includes a serious roof leak, serious storm damage and any fault likely to injure someone or damage property. Gutters land on that list more often than owners expect, because a packed gutter in a Mackay February does not politely overflow into the garden. It backs up under the roof sheet and comes through a ceiling.

If it is an emergency, the tenant contacts you or the nominated repairer named in the agreement. If they cannot get either of you, they may arrange a suitably qualified person themselves, up to the value of 4 weeks rent, and you must reimburse within 7 days of being given notice of the cost. A tenant choosing the trade at 9pm during a cyclone watch will not be shopping on price. Naming a repairer in the tenancy agreement, and answering the phone, is the cheapest control you have.

If it is routine, there is no fixed number of days in the Act, only what is reasonable. If it drags, the tenant issues a notice to remedy breach giving you at least 7 days to fix it, then can apply to the Residential Tenancies Authority dispute resolution service and on to the tribunal. A $250 clean turns into a conciliation conference over nothing. Get it done.

For property managers: the file that ends the argument.

Most gutter disputes we get called into are evidence problems, not plumbing problems. Four habits fix nearly all of them.

  1. Photograph the gutters at the entry condition report. One shot per elevation from the ground. It settles every future argument about who let them fill.
  2. Book the clean by the calendar, not the complaint. In Mackay that means one clean in September or October before the wet, and a second in June or July after the worst of the leaf drop and the start of the cane crush.
  3. Keep the invoice with the address and the date on it. It is the same document that defeats a lack-of-maintenance argument from an insurer, so it does double duty. Our insurance claim page explains why.
  4. Photograph again at the exit condition report. Fair wear and tear is the test at the tribunal, and 12 months of gum leaf in Mackay is fair wear and tear.

Repair or capital improvement: the tax line that matters.

This is general information, not tax advice, and your accountant decides how it applies to your return. That said, the distinction is consistent enough to plan around.

  • Usually a deductible repair: a gutter clean, a downpipe reconnection, patching or replacing a rusted section of an existing run, re-bracketing a sagging length. You are restoring what was there.
  • Usually capital: replacing every gutter on the house, or fitting gutter guard where there was none. Replacing an entirety, or making the property better than it was, is an improvement and typically becomes a capital works deduction written off at 2.5 percent a year rather than a deduction this year.
  • Watch initial repairs: defects that existed when you bought the property are generally capital even if you fix them the week you settle. If you bought a Mackay rental with rusted gutters, the re-gutter is usually not an immediate deduction.
  • Keep the invoices split. Ask for the clean, the repair and any improvement itemised separately on the one invoice. It costs us nothing and it saves your accountant an hour.

On the numbers, a $2,100 to $3,800 guard install against $180 to $550 a year of cleaning does not pay for itself quickly on a single-storey house. It pays for itself on a two-storey, on a heavily treed block, or where the same tenant keeps reporting the same overflow and you are paying an after-hours attendance of $280 to $550 each time. Everywhere else, the honest answer is that scheduled cleaning is the better spend, and we will tell you so at the measure.

At least 24 hours written entry notice for repairs and maintenance, using the RTA entry notice form. Entry has to be at a reasonable time, generally between 8am and 6pm, and not on a Sunday or public holiday unless the tenant agrees. A routine inspection is different again: 7 days notice, and no more than once every 3 months.
Can a tenant be charged for blocked gutters at the exit inspection?
Only where the blockage is damage they caused rather than fair wear and tear, and you need the entry condition report and dated photographs to prove it. Leaf, cane trash and gum litter accumulating over 12 months in Mackay is fair wear and tear, not tenant damage. A tenant who put shade cloth over a gutter or blocked a downpipe is a different conversation, and that repair is usually $150 to $350.
Is gutter guard on a rental a repair or a capital improvement?
Fitting mesh where there was none before is an improvement, so it is generally treated as capital rather than an immediate deduction, often as capital works written off at 2.5 percent a year.
